1. The service
AnswersTheCall provides a professional virtual receptionist subscription: call answering, appointment booking, messaging, and related features, according to the plan you select.
2. Subscription and billing
Plans are billed monthly in advance by card through our payment processor. There is no contract term — you may upgrade, downgrade, or cancel at any time. Cancellation takes effect at the end of the current billing period; fees already paid are non-refundable. Usage above your plan's included minutes is billed at the published overage rate.
3. Your responsibilities
You are responsible for: (a) the accuracy of the business information, hours, and call-handling rules you provide; (b) complying with call-recording consent laws in your jurisdiction, including any required caller notices; (c) lawful use of SMS messaging, including required opt-outs.
4. Acceptable use
You may not use the service for unlawful, deceptive, or harassing communications, or to impersonate any person or business other than your own.
5. Service levels
We aim for high availability but do not guarantee uninterrupted service. Enterprise plans may include a contracted SLA; all other plans are provided on a commercially reasonable efforts basis.
6. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim is limited to the fees you paid in the three months before the claim arose. We are not liable for indirect, incidental, or consequential damages, including lost revenue from missed or mishandled calls.
7. Changes
We may change these terms with reasonable notice. Continued use after changes take effect constitutes acceptance.
8. Governing law
These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules.
